SEC’s Mark Uyeda Says U.S. Crypto Policy Has Completely Reversed
SEC Commissioner Mark Uyeda says U.S. crypto policy has undergone a dramatic reversal.
Uyeda criticized the Biden-era SEC for relying on “regulation by enforcement,” arguing that the approach effectively pushed crypto innovation away from the United States.
He pointed to three major changes under the current SEC.
First, the agency has pulled back enforcement cases it believed were unlikely to hold up.
Second, regulators have worked to provide clearer boundaries around which crypto activities fall inside or outside SEC jurisdiction.
Third, the SEC has proposed a new fundraising framework that could allow qualifying crypto projects to raise as much as $75 million in a 12-month period without going through full traditional securities registration.
Uyeda says he is also optimistic that Congress will ultimately pass the CLARITY Act and provide a broader market-structure framework.
The direction of U.S. crypto policy has changed quickly.
The debate is increasingly shifting from whether crypto should operate in America to how it should be regulated.
